How radon-resistant construction requirements reach an actual house
Buyers of newer homes are frequently told the house was "built to code for radon", and take that to mean the question is settled. The path from a radon-resistant construction provision to a working feature in one specific house runs through four separate stages, and it can break at any of them.
Understanding the chain is what lets you ask the right question of a builder, and it explains why a house with a passive system installed can still test above the action level.
Stage one: the model code
Radon-resistant new construction provisions originate in model codes and consensus standards, which are published by standards bodies rather than by governments. On their own they require nothing of anyone — a model code is a template.
The provisions themselves are consistent in shape: a gas-permeable layer beneath the slab, a sheet membrane over it, sealed joints and penetrations, and a vent pipe running from the sub-slab layer to above the roofline. That pipe is the part homeowners can usually find.
Stage two: state adoption
A model provision becomes enforceable only when a jurisdiction adopts it, and adoption is neither uniform nor automatic. States adopt different code editions in different years, and radon provisions are among the items most frequently amended during adoption.
The result across the ten states we serve is genuine variation in whether radon-resistant techniques are required in new residential construction, where they are required, and from what date. Nebraska, for example, has moved to require radon-resistant construction techniques in new residential construction — a requirement worth confirming with the state programme for current scope, since new-construction rules in several states have changed in recent years.
Because this is exactly the kind of detail that goes stale, we point homeowners at the state programme rather than restating a requirement that may have been amended. Each state resource centre carries the agency that answers it.
Stage three: local amendment and enforcement
Municipalities and counties frequently amend adopted codes, and enforcement capacity varies. A provision that is technically in force is not the same as a provision that was inspected on your lot on the day the slab was poured.
This is not a claim that builders cut corners. It is an observation about how many independent parties have to do the right thing for a buried, invisible feature to work as intended — the aggregate layer, the membrane, the seals, the pipe, and the pipe’s connection to a functional sub-slab layer, none of which is visible once the slab is down.
Stage four: what got built, and whether it works
A passive system relies on the stack effect in the vent pipe to draw a small amount of soil gas. It reduces indoor radon in many houses and is insufficient in others, which is why radon-resistant construction is a starting position rather than a result.
A rough-in can also fail quietly. A pipe terminating in an inadequate aggregate bed, or one crushed or blocked during construction, will not perform however good the design was on paper. None of that is visible from the finished house, and none of it is detectable without measuring.
This is the practical conclusion: a new house with a passive system still needs a test, and a house that tests high with a passive system installed is usually a good candidate for activation rather than a full retrofit.

- Ask whether a passive rough-in was installed and where the vent pipe runs.
- Look in the attic for a labelled PVC riser exiting the roof.
- Test the finished house under closed-building conditions regardless of the answers.

Our house is new. Does it need a radon test?
Yes. Construction age changes nothing about the ground beneath the slab, and a tight modern envelope can strengthen the pressure difference that draws soil gas in. Radon-resistant features reduce levels in many houses and are insufficient in others; only a measurement tells you which yours is.
The builder says the house is radon-ready. What does that mean?
Usually that a passive vent pipe was roughed in. It is a genuine head start, because the most labour-intensive part of a retrofit already exists. It is not a result, and it is worth asking specifically whether a fan is fitted, since "radon-ready" normally means it is not.
Does a passive system need to be activated?
Only if the house tests above the level you decide to act on. Activation is an engineering evaluation of a buried installation nobody watched being built — diagnostics first, then sealing, then a fan sized to measured conditions, then a verification test.
Can we find out what code applied to our house?
Usually, yes. The permit record held by the local building department identifies the code edition in force, and the builder can normally tell you what was installed. Both are reasonable things to request, particularly on a recent build still within any warranty period.
